Official Contest Rules

This is a skill-based contest, and chance plays no part in the determination of winners. By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules.

Sponsor
This contest is sponsored by Sam's Chowder House ("Sam's") at 4210 North Cabrillo Highway, Half Moon Bay, CA 94019.

Term
The contest begins Friday, October 1, 2010 at 12:00 am PST, and runs through Friday, November 26, 2010, at 11:59 pm PST. Voting will occur between November 27, 2010 and December 10, 2010. Winners will be announced on or about December 13, 2010, and notified by email.

Who May Enter
The contest is open only to legal residents of the fifty (50) United States (excluding Arizona, New Jersey and Vermont) and the District of Columbia. CONTEST IS VOID IN ARIZONA, NEW JERSEY, VERMONT, AND WHERE PROHIBITED BY LAW. You must be at least 16 years old to enter this contest.  Employees of Sam's Chowder House and Sam's ChowderMobile are not eligible to participate.

Prizes
There are seven categories, and participants may submit up to three photos per category.

• Best Scenic View at or from Sam's	• Best Group Shot taken at Sam's
• Best Restaurant Shot of Sam's	• Best People Shot taken at Sam's
• Best Food Shot of Sam's food	• Best Sam's ChowderMobile Shot
• Best Outdoor Dining at Sam's

For each category, prizes include a first place award of $100, a second place award of $50 and a third place award of $25. In addition, a single Grand Prize winner will be selected and will win an award of $1,000 for the best overall photo. All prizes are in US dollars. The Grand Prize award winner will also receive the following exposure for their winning photograph:

• Photo and credits published in the Half Moon Bay Review newspaper
• Photo displayed at Sam's Chowder House
• Photo featured on Sam's website
• Photo highlighted on Sam's blog
• Photo featured in Sam's email newsletter

License
By entering your photos in Sam's Photo Contest, you hereby grant to Sam's Chowder House and Sam's ChowderMobile (i) a nonexclusive, worldwide, irrevocable, royalty-free license to reproduce, distribute, and publicly display the photographs you submit in any promotion, website, advertisement, press activity, or other marketing activities, and (ii) the right to use your name, city, and state in promotions and other publications.

The photograph must be an original work taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges, and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the photograph.

Judging
Judging consists of two (2) rounds of evaluation for each category, and then selection of a final Grand Prize winner. In round one, judges from Sam's Chowder House will select the top ten photos in each category. In round two, the panel of contest judges will vote on their top choice in each category. The judges will collectively select a Grand Prize Winner from the round two entries. Entries will be judged based on their quality, composition, color, and creativity as well as being the best overall representation of Sam's Chowder House. Photos will be judged anonymously by the panel of judges, and names won’t be revealed until the winners are selected. In the event of a tie, the tied entries will be resubmitted to the judges, who will vote again between the tied entries alone.

Noncompliance or return of prize notification as undeliverable, whether by regular mail or email, may result in disqualification and selection of an alternate potential winner.

How to Enter
Photographs must be in digital format, and in color. Only digital entries will be eligible. No print or film submissions will be accepted for entry into this Contest. All digital files must be a minimum resolution of 800x600 pixels, a maximum file size of 4MB, and in JPEG or JPG format. Photograph must have been taken within one year from submission, and may not have previously won an award. Sharpening, color correction, cropping and other photo manipulation may be done on any photograph.

All photos must be taken of Sam's restaurant, property, food, or view that is visible directly from Sam's Chowder House.

Participants may submit up to three photos in each category by following the online directions published on Sam's Chowder House website. Alternatively, you can provide Sam's with a CD of your photos – all entries submitted this way must be received by November 15, 11pm PST. To do this, just print the entry form from the website, complete it and include it with your photo entries, to: Sam's Chowder House at 4210 North Cabrillo Highway, Half Moon Bay, CA 94019, Attn: Photo Contest. Be sure to include your name, phone, and email address. Photographs will not be returned.

For any shots that include clearly identifiable people, each entrant must be prepared to provide a signed Photo Release from those persons who appear in the photograph submitted. All releases must be in the form provided by Sam's. Failure to provide such releases upon request may result in disqualification at any time during the Contest and selection of an alternate winner.

Potential winners will be required to sign and return a winner's release provided by Sam's within ten (10) days following an attempted notification, that confirms you are the owner of the photograph (and all the intellectual property rights in the photograph submitted) and grants to Sam's Chowder House the irrevocable perpetual, nonexclusive license to reproduce, distribute, display, and create derivative works of the entry in connection with the Contest and promotion of the Contest without additional compensation. Failure to execute and deliver any required documents by the specified deadline may result in disqualification from the Contest, and selection of an alternate potential winner.

Limitation of Liability
By entering this Contest, all entrants agree to release, discharge, and hold harmless Sam's Chowder House ("Sam's") and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

Sam's Chowder House assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. Sam's is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to in this Contest.

Conditions
THIS CONTEST IS VOID WHERE PROHIBITED. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply.

By entering, entrants also agree (a) to be bound by these Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins that Sam's may use the winning photographs and each winner's name, photograph, likeness, in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law).  All federal, state and local taxes, fees and surcharges on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or does/do not respond within ten (10) days to a winner notification as required by the "Contest Prizes" Rules above, or refuses the prize, the prize will be forfeited and Sam's, in its sole discretion, may choose whether to award the prize to another entrant.

Right to Cancel Contest
If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sam's that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sam's reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sam's elects to cancel or terminate the Contest, Sam's will not retain any rights in the submitted photographs.

Winners List
Winners' names will be available online at www.samschowderhouse/photocontest on or about  the week of December 13, 2010. Alternatively, for names of winners send a self-addressed, stamped envelope to Sam's Chowder House at 4210 North Cabrillo Highway, Half Moon Bay, CA 94019, Attn: Photo Contest.

Data Privacy
Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules.  Personal data will be used by Sam's exclusively for the purposes of the Photo Contest.
